False Accusations and Flawed Investigations by NZ Immigrations
In 2016, our lives were shattered when we were wrongly accused of a crime we did not commit. The accusation stemmed from a flawed investigation, fuelled by misinformation and unverified assumptions, as 11 Papua New Guinean villagers, who misled the Swarbricks to come to New Zealand, lied under oath and misled NZ government authorities for their personal gain. Despite our protests of innocence, we were charged and subjected to a gruelling trial.
Home Raids, Trauma and Damage on Marriage, Children and Life
Our homes were raided as part of the investigation. Our children were young and watching every ordeal. For eight long years, we fought for justice, enduring a gruelling ordeal that included international media scrutiny, financial ruin, and emotional devastation and damages to our public image. Our family was torn apart, our marriage tested, and our business and jobs destroyed.
Trial Ignored Immigration Flaws
Furthermore, our defense team identified significant discrepancies in the prosecution witness statements during the NZ Immigration investigations. These discrepancies were raised during our trial, but unfortunately, they were not adequately addressed.
The contradictory statements and unexplained inconsistencies in the prosecution’s witness testimony cast doubt on the reliability of their evidence. The failure to resolve these discrepancies contributed to the miscarriage of justice and highlights the need for a thorough review of the investigation and prosecution processes.
Devastating Blow by Judge Spear in Unfair and Unbalanced Summing
The prosecution’s case relied heavily on circumstantial evidence and questionable witness testimony, which was later, disputed by experts and discredited in appeals. However, the damage was done.
In a devastating blow, Judge RLB Spear’s unfair and unbalanced summing up led to our wrongful conviction and sentence of home detention. This miscarriage of justice sparked a relentless fight for justice that would last eight years and more. The damages caused are beyond comprehension.
Justice By Appeal :Damage Must be Recompensed
But we refused to give up. In 2024, our persistence paid off when we won our Appeal on the grounds of “Miscarriage of Justice- based on the Judge Spear’s unfair and unbalanced summing up”. However, the scars of our ordeal will remain forever, unless compensated for.

- Financial losses have been crippling, but emotional tolls have been far greater.

- We’ve felt abandoned by the system, betrayed by those who swore to protect us. But we will not be silenced. We will not be defeated as we will continue to argue our case in the “Courts of Heaven” where true justice is served.
We Seek Full Justice and Compensation as a Fundamental Human Right
The Kewa-Swarbrick story is a testament to resilience and a reminder that true justice is a fundamental human right. We are seeking full compensation for the immense losses we have suffered since 2016, including financial losses, damage to our health and wellbeing, and emotional distress. The false accusations and subsequent miscarriage of justice have had a devastating impact on our lives, and we demand reparations for the harm caused.
