In 2016, we helped 16 Papua New Guinea (PNG) people come to New Zealand on holiday visas for a 3-month sponsored cultural program. The learning they gathered would then be brought back to PNG to help improve their communities and those who needed help (as shown in the image above). The Swarbricks have been all over PNG in their professional line of work, and saw the poverty stricken communities that were lacking basic services due to corruption and lack of management. They embarked on a down stream solution pathway that would touch the lives of ordinary people including women, children, youth, old and young people. “Hope for the hopeless” was the passion drive.

The authentic pilot program was designed by C. K Swarbrick. Branded as Eductaion on Mindset Transformation through Global Exposure (EMT-TGE), under Vision4040, Christina saw the need for education that would transform the mindsets of PNG citizens to combat corruption and poverty in the Nation. The only way for such an outcome was to “give exposure” to systems and model nations that had developed human and physical infarstrucre. Christina chose New Zealand as the model pathway to trial out this model. She put in a process, and in the end, chose 16 PNG Nationals to trial the model, by coming to NZ on 3 month fully sponsored program by stakeholders. She applied for Holiday Visas, for it was the correct visa requirement. The participants only came up with K2500 (NZ$1000) for their entire 3 months. Any Kiwi (NZ citizen) knows that $1000 doesn’t get us through for living costs in NZ for 3 months. However, these 11 PNG nationals made it look like they had paid so much in holiday costs for their return airfares, food, accommodation, travel, medical, 5 meals a day, all provided for by the Swarbrick’s in their million dollar family home, which accommodated all of them in master bedroom ensuites.

However, upon arrival, 11 of the participants lied to and misled New Zealand Government authorities, claiming they were brought to work illegally under visitor, and that they were not paid.

INZ claimed we brought the participants on holiday visas to work illegally, despite no evidence of employment or wrongdoing. This false narrative led to Antony Swarbrick and me being charged, convicted, and sentenced to home detention in 2023.

We won the case in the New Zealand Courts. Our false charges were dismissed. We were exonerated. There was miscarriage of Justice because Judge Spears was forceful and influnced the Jury. It was messy. We only need 11 PNG con-artists to destroy the pathway for PNG and NZ, on great working terms in building stronger alliances. Eeven Judge Spears commended the work Christina did in the communities (both in NZ and PNG) and said in his ruling: ” I accept that you are person who is of good character in all other respects, that you have worked hard for the community both here (NZ) and in Papua New Guinea.”

– We applied for and received holiday visas for a sponsored cultural program, mostly paid by us.

– The participants lied to and misled NZ Government authorities upon arrival.

– INZ failed to conduct proper checks, leading to their false claims.

– We were not employers and did not employ anyone.

– INZ’s investigator, Warren Smith, had a vested interest in promoting a false narrative for personal gain, and so he continued a costly investigation.

Regrettably, Judge R.L.B. Spear’s unfair and unbalanced summing up led to a miscarriage of justice. His bias perpetuated the false narrative, resulting in our wrongful conviction.

At the trial, witnesses from various levels of the checking process testified, yet none picked up on the alleged “mistakes.” This raises questions about INZ’s competence and visa administration processes.

We’re setting the record straight to address the false beliefs and misconceptions. We hope this account will:

– Clarify the true purpose of the trip

– Expose the false accusations

– Highlight INZ’s failures and biases

– Reveal judicial bias and the miscarriage of justice
